ChatCop Terms of Service

1. Definitions
In addition to the definitions provided in NiceBots’ main Terms of Service available at /legal/terms, for the purpose of these ChatCop-specific Terms: “ChatCop” refers to the Discord bot service provided by NiceBots for automatic moderation in Discord servers. “Discord” means the online communication service that allows for voice, video, and text communications among its users. “Discord Server” refers to a digital space on Discord where users can communicate in real-time. “Discord Channel” means a subsection within a Discord server where users can communicate on a specific topic. “Kick” refers to an action taken to temporarily remove a user from a Discord server. “Ban” means an action taken to permanently remove a user from a Discord server. “Message Deletion” refers to the automatic or manual removal of a user’s message from a Discord server. “AI Moderation” means the use of automated, artificial intelligence technology to monitor, detect, and act upon inappropriate or specific types of content within a Discord server. “18+ Content” encompasses content intended for adults only, including but not limited to explicit language, nudity, sexual content, or pornography.
2. Relationship to Main Terms
These ChatCop Terms of Service (“ChatCop Terms”) constitute a supplement to the main NiceBots Terms of Service. By using ChatCop, you acknowledge and agree to be bound by both these ChatCop Terms and the main NiceBots Terms of Service. In the event of any conflict between these ChatCop Terms and the main Terms, these ChatCop Terms shall prevail with respect to your use of ChatCop specifically.
3. Service Authorization
By integrating ChatCop into your Discord server, you, as the server owner or administrator, explicitly authorize ChatCop to store and process messages and information related to moderation actions conducted by ChatCop or through manual invocation by a third party. You acknowledge your responsibility for ensuring that your use of ChatCop complies with applicable laws, your Discord server’s guidelines, and these Terms. You further agree to inform your Discord server members about the use of ChatCop and its associated data processing activities, such as through your server’s rules that members must accept before joining.
4. Communications Channel
During ChatCop setup, you must designate a logs channel for moderation logs. This channel will be subscribed to our official updates channel through Discord’s features. This subscription serves as our primary communication method regarding ChatCop’s terms of service, privacy policy, and other critical information. Should you disable this feature, you assume responsibility for staying current with our terms of service and privacy policy through regular checks of our website.
5. Data Processing and Retention
ChatCop maintains records of automatic and manual moderation actions, including but not limited to infractions, kicks, and bans. This data is retained for a period of two years following ChatCop’s departure from a server or upon receipt of a deletion request via email to hello+legal@nicebots.xyz. Message content may be shared with third parties solely for AI moderation core feature functionality. We categorically prohibit the sale of user data. We collect and store usage data, including message processing volumes, moderation action frequencies, and language preferences, to enhance ChatCop’s service and provide support.
6. Security Measures
We implement comprehensive security measures to protect all data stored by ChatCop. In the event of any cybersecurity incident, we will notify affected users in accordance with the laws applicable in Lausanne, Switzerland.
7. Service Termination
We maintain the right to terminate ChatCop services for any user or Discord server without prior notice, particularly in cases where servers promote illegal activities, contain or promote 18+ content, provide cryptocurrency or financial advice, or engage in gambling, as determined by the laws of Switzerland, the United States, or the server owner’s jurisdiction. While termination may occur without stated cause, it is more likely under the aforementioned circumstances.
8. Warranty Disclaimer
ChatCop services are provided “as is” and “as available” without warranties of any kind, whether express or implied, regarding availability, accuracy, reliability, suitability, or completeness of the services.
9. Legal Framework
These ChatCop Terms shall be governed by and construed in accordance with the laws of Lausanne, Switzerland, without regard to its conflict of law provisions, consistent with the main NiceBots Terms of Service.
10. Modifications to Terms
We reserve the right to modify these ChatCop Terms at any time. Notifications of changes will be posted on our website and within the ChatCop support Discord server. Continued use of ChatCop following such modifications constitutes acceptance of the revised terms.
